1. Acceptance of Terms
By using this website or booking an inspection, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.
2. Services Provided
Nomad Property Inspectors provides residential and commercial property inspection services, including pre-purchase inspections, healthy home testing, pre-listing walkthroughs, periodic health checks, and remote owner advocacy. Specific services, scope, and pricing are confirmed at the time of booking. Service availability may vary by location.
3. Inspection Scope and Limitations
Our inspections are visual assessments of accessible areas and systems at the time of inspection. They are not exhaustive engineering analyses, warranties, or guarantees of condition. We inspect what is visible and accessible; concealed areas, buried systems, and items outside safe reach are excluded from scope. Our written report reflects conditions observed on the inspection date and does not predict future performance or latent defects. All inspection services are also governed by the Pre-Inspection Agreement signed prior to each engagement.
4. Client Responsibilities
You agree to: provide accurate property information at the time of booking; ensure safe and lawful access to the property on the scheduled date; review the Pre-Inspection Agreement before the inspection begins; and use the inspection report solely for your own property evaluation purposes. You may not share, sell, or use the report in any manner that misrepresents our findings.
5. Payment Terms
Payment is due as specified at the time of booking. Cancellations made less than 24 hours before a scheduled inspection may be subject to a cancellation fee. Refunds, if applicable, are issued at the sole discretion of Nomad Property Inspectors and in accordance with the terms communicated at booking.
6. Limitation of Liability
To the fullest extent permitted by law, Nomad Property Inspectors’ total liability to you for any claim arising from our services or your use of this website shall not exceed the fee paid for the specific inspection giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or property value. This limitation applies regardless of the form of the action and whether the claim is based in contract, tort, or any other theory.
7. Dispute Resolution
Any dispute arising from these Terms or our services shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Ventura County, California. You waive the right to participate in class action lawsuits or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Ventura County, California.
9. Modifications
We may update these Terms at any time by posting the revised version on this page with an updated “Last updated” date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
